• Phoenix Auctions is the trading as name of Rising Corporations Ltd, registration number 16034139. The registered address must not be used by sellers to send in consignments. Please refer to clause 8 for the consignment shipping address.
• By accessing and using the Phoenix Auctions website and services, you agree to comply with and be bound by the following Terms & Conditions.
• Phoenix Auctions reserves the right to update or modify these terms at any time without prior notice. Continued use of the website and services after any such changes constitutes your acceptance of the new terms.

2. Account Registration and Security

• Registration: To use certain features of Phoenix Auctions, you must create an account. You agree to provide accurate and complete information during the registration process and to update this information as necessary to keep it accurate and complete.
• Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify Phoenix Auctions immediately of any unauthorised use of your account or any other breach of security.

3. User Conduct

4. Listing and Selling Items

• Item Submission: Sellers send their item/s to Phoenix Auctions for secure holding. Our team will handle the photography and create detailed write-ups for each item. Sellers have the option to review and provide input on the item descriptions before they are finalised.
• Accuracy and Condition: Sellers must ensure that the item/s are accurately represented and, in the condition, described. Any damage or defects should be disclosed upon submission. Misrepresentation of items is strictly prohibited.
• Legal Ownership: Sellers must have the legal right to sell the item/s they submit to Phoenix Auctions. All item/s must be free of any encumbrances or legal disputes.

5. Handling and Insurance

• Item Acquisition: Sellers will send their item/s to Phoenix Auctions for secure holding and inspection before they are listed for auction.
• Business Insurance: Phoenix Auctions maintains business insurance to cover the item/s while they are in our possession and during shipping to buyers. This ensures protection against damage or loss.

6. Bidding and Buying

• Binding Bids: Placing a bid on an item/s constitutes a binding offer to purchase the item/s at the bid price. If you win an auction, you are legally obligated to complete the purchase.
• Payment: Buyers must pay for item/s they have won within 5 working days. Failure to do so may result in account suspension or termination.

7. Fees and Payments

• Service Fees: Phoenix Auctions charges a service fee for listing and selling item/s. The fee structure is outlined on the website and is subject to change without notice.
• Payment Processing: Phoenix Auctions uses third-party payment processors to handle transactions. You agree to comply with the terms and conditions of these payment processors.

8. Shipping and Delivery

• Seller’s Responsibility: Sellers are responsible for shipping their items to Phoenix Auctions Office C, Knightstone Causeway, Weston-Super-Mare, BS23 2AD, where we will handle secure storage and dispatch to buyers.
• Buyer’s Responsibility: Buyers are responsible for providing accurate shipping information and for paying any applicable shipping costs.

9. Dispute Resolution

• Dispute Resolution: In the event of a dispute between buyer and seller, Phoenix Auctions may mediate to help resolve the issue, but does not guarantee a resolution including but not limited to a refund.

10. Intellectual Property

• Ownership: You retain ownership of the content you post but grant Phoenix Auctions a licence to use and or remove said content.
• Rights: Ensure you have the rights to any content you post.

11. Limitation of Liability

• No Warranty: Phoenix Auctions provides the website and services “as is” and without any warranty or condition, express, implied, or statutory. Phoenix Auctions specifically disclaims any implied warranties of title, merchantability, fitness for a particular purpose, and non-infringement.
• Limited Liability: In no event shall Phoenix Auctions be liable for any direct, indirect, incidental, special, consequential, or exemplary damages arising from or in connection with your use of the website or services.

12. Termination

• Right to Terminate: Phoenix Auctions reserves the right to terminate or suspend your account at any time for any reason, including but not limited to violations of these Terms & Conditions.
• User Termination: You may terminate your account at any time by contacting us. Upon termination, you must cease all use of the website and services.

• These Terms & Conditions shall be governed by and construed in accordance with the laws of the United Kingdom. Any disputes arising from or relating to these terms shall be subject to the exclusive jurisdiction of the courts of the United Kingdom.
